In a recent post, Eugene Volokh reports on the Second Circuit decision in Authors Guild, Inc. v. HathiTrust, No. 12‐4547‐cv (2d Cir. June 10, 2014), wherein the Court held that scanning so that users can search the full text but not read the full text is “transformative,” and therefore a “fair use,” not a copyright violation.
