At the Employment & Labor Insider, Robyn Shea asks and explores this question while analyzing a US Court of Appeals Fourth Circuit case involving Title VII’s anti-retaliation protections. Interestingly, the Fourth Circuit decision was by a panel of Third Circuit judges sitting by designation because all of the members of the Fourth Circuit were recused from hearing the case.
